French court shortens Le Pen's ban from office but orders electronic tag

The Paris Court of Appeal has upheld Marine Le Pen's conviction for misusing EU funds ​but shortened ‌her ban ⁠on running for elected office, ‌potentially re-opening a path for the ⁠far-right leader to run in the 2027 presidential ​race.

However, the court ‌ruled that Le Pen will serve a three-year jail term. Although ‌the court said two ​years were suspended, it ordered her to wear an electronic ankle ​tag for one ​year, making a presidential ​campaign politically and logistically difficult.

The ​ruling casts fresh doubt on whether she will seek France's highest office next ⁠year.

  1. This is a judgment of Solomon that leaves Marine Le Pen’s political future still hanging in the balance.

    On the one hand, the panel of appeal judges has been significantly more lenient than the original court on the question of ineligibility.

    The five years handed down at the original trial has been cut, in effect, to 15 months. This is time already served (since the original sentence) so Le Pen is now, juridically, able to run.

    However, there’s a but.

    This is the confirmation that Le Pen must also serve a year in jail. In practice not in jail, but at home with an electronic tag.

La décision judiciaire est désormais connue : Marine Le Pen, condamnée mardi à 45 mois d’inéligibilité, dont 30 avec sursis, peut a priori être candidate à la présidentielle de 2027, mais la cour d'appel de Paris l’a aussi condamnée à un an de bracelet électronique. La cheffe de file de l’extrême droite avait conditionné sa candidature à l’absence de condamnation au port d’un bracelet. Elle doit s’exprimer au journal de 20 heures de TF1.

    Cet arrêt crée un scénario inédit pour l’élection présidentielle des 18 avril et 2 mai prochains. La cheffe de file de l’extrême droite française peut théoriquement briguer une quatrième fois l’Elysée en 2027 – puisqu’elle a purgé 15 mois d’inéligibilité après sa condamnation en première instance du 31 mars 2025 – mais elle devra faire campagne sous bracelet électronique, ce qu’elle a toujours refusé d’envisager.

    "Nous avons anticipé tous les scénarios", avait assuré lundi le président du parti d’extrême-droite Rassemblement National (RN) du Parlement européen à Strasbourg où il se trouvait, se disant "serein et prêt à assumer les conséquences" de la décision de la justice.

  3. Marine Le Pen è stata condannata in appello per appropriazione indebita.

    Condannata a tre anni di carcere, due dei quali sospesi, e 45 mesi di ineleggibilità, di cui 30 sospesi. Dovrà però portare per un anno il braccialetto elettronico. Marine Le Pen potrebbe comunque candidarsi alle Presidenziali del 2027.

  4. Le Pen has herself said that she would not run as candidate in those conditions, because she would not be fully at liberty.

    In theory then she should now be handing over the candidacy to Jordan Bardella.
